Lexum’s Annotated Civil Code Of Québec terms of Use

Foreword
For the interpretation of the present terms of use, the following acronyms and expression means:
- “ACCQ”: Lexum’s Annotated Civil Code of Québec http://ccq.lexum.com/ccq/home.do?lang=en;
- “Lexum”: The legal technology company and the creator of the ACCQ: http://www.lexum.com/en;
- “CanLII”: CanLII website, to which ACCQ users are directed when they consult a decision associated with an ACCQ section, http://canlii.org/en;
- “Partners” Partners of the ACCQ, specifically Lexum, CanLII and its own partners, the contributors and the ACCQ advertising partners ;
- “User” Anyone accessing the ACCQ ;
- “Contributor” Any user adding a contribution to the ACCQ ;
- “Contribution” All editorial inputs or any other material added to the ACCQ by Lexum or by contributors.
User Agreement
Every person who accesses the ACCQ consents, as a User, to the terms of use stated in the present document and to the fact that Lexum reserves the right to amend these terms from time to time.
Every user who accesses, through the ACCQ, CanLII’s website, consents to CanLII’s terms of use which are available at the following address: http://www.canlii.org/en/info/terms.html.
Privacy Protection
The ACCQ abides by Canadian and international standards with regard to user privacy protection. The ACCQ does not collect personal information about Users without their consent, and has set up means to keep personal information confidential.
Reproduction and Copyright
Lexum, reserve its intellectual property rights pertaining to the ACCQ’s graphic, and navigation and search tool design.
Subject to the following section “Prohibited Uses” and the below conditions pertaining to prohibited use, legal materials published on ACCQ, such as the Civil Code of Québec sections, and the associated annotations can be copied, printed and distributed by Users free of charge and without any other authorization from Lexum. This authorisation includes editorial enhancements added by Lexum or the ACCQ contributors, such as annotations, commentaries, hyperlinks and other information, provided that the ACCQ is identified as the source of the document.
Notwithstanding these terms of use, contributors reserve all of their rights in their own contributions. Accordingly, Lexum reserves all of its rights to its own contributions.
Unless expressly requested by the contributor, every contribution submitted to Lexum to be integrated to the ACCQ will be ruled by the present terms of use, without any additional conditions.
Moderation
Lexum and the Editors of the ACCQ reserve the right to refuse to publish, as well as the right to delete, the annotations done by a contributor, all without notice. More specifically, all annotations submitted which contain text that is, in whole or in part inappropriate, notably language that is uncalled for, hateful, defamatory, racist, or otherwise, will be refused.
Equally excluded are those annotations which, despite their pertinence, are protected by or may be protected by the copyright of a third party. More specifically, all text, or parts of text, cited from another publisher of legal materials or all summaries which are the result of the editorial work of a court or a tribunal, on a decision or relating to a decision, will be automatically excluded.
Prohibited Uses
Notwithstanding the reproduction rights granted in the preceding section, the following uses of the ACCQ are prohibited unless Lexum has provided prior written consent:
- Incorporating published documents into another website but masking their origin or source through framing, re-use of search processes, or any other means of creating confusion and misrepresenting the fact that the documents come from the ACCQ;
- Use of the ACCQ resources and services via automated mechanisms, in particular for bulk downloading of documents.
Lexum reserves the right to block, at its discretion and without prior notice, any User from accessing the ACCQ if the User misuses the website or uses it for illegal purposes.
Disclaimer of Warranty
Lexum puts considerable effort into maintaining the ACCQ and controlling the quality of the databases and documents it publishes so as to provide a reliable source of legal information. However, Lexum and its partners provide no warranty and make no claims as to the reliability, accuracy or integrity of the website’s content or functioning.
Even if the ACCQ editors verify the validity of the commentaries, annotations, analyses and modifications done by the contributors, it does not engage the liability of Lexum and its partners.
Disclaimer of Liability
The documents published on the ACCQ have been collected and prepared for Users’ convenience, and uniquely for informative purposes; they are in no way legal advice. Despite the care taken in preparing and maintaining the ACCQ, Lexum, its partners and their respective employees, managers and other officers can in no way be held responsible for damages caused directly or indirectly by use of the ACCQ or by its non-availability.
Applicable Law
Use of the ACCQ is governed by the federal and provincial legislation in force in the Province of Quebec, Canada. Any legal action against Lexum in regards to the ACCQ use shall be brought before the courts of the District of Montreal in the Province of Quebec.
